Auction Terms

 

All bidders must read and agree to all terms and conditions of sale before participating in an auction:

  1. We do have a 10% buyers premium on all household and estate auctions, when you win the final bid that is the price plus 10% of the winning bid and any taxes. At the present time we are still having no 10 % buyers premium on Farm Sales and if there is , we will announce it.
     
  2. Payment is expected from the winning bidder immediately after the end of the auction. All accounts are payable to "Bush Auctioneering  ". Payment must be made in US funds.
     
  3. Acceptable forms of payment for winning bids are Cash and personal checks drawn on U.S. banks. If a personal check is submitted as payment, the buyer agrees to pay Bush Auctioneering Service a fee of $25 for each returned check.
     
  4. PLEASE! No Out of State Checks, Foreign Buyers Need A Letter Of Credit From Your Bank

     
  5. Once a lot is sold & the auctioneer acknowledges the successful bidder of a lot, you the successful bidder assumes all risk & responsibility with regards to the lot.

     
  6. All property that is purchased must be removed the day of the sale unless other arrangements are made in writing & agreed to by Bush Auctioneering Service . Upon conclusion of an auction, Bush Auctioneering Service relinquishes all responsibility for sold lots.
     
  7. In no event will Bush Auctioneering Service  liability to a buyer exceed the actual purchase price of a lot.
     
  8. Some of the lots offered in a sale may be offered subject to a "reserve," unless the auction is specifically advertised as "unreserved." The reserve is a confidential price between the consignor and Bush Auctioneering Service  below which the item will not be sold.
     
  9. The Bush Auctioneering Service  auctioneer has sole discretion over what bids are accepted and in what order. In the case of a tie for high bid, it is the auctioneer's decision on which bid to recognize. And the auctioneer's decision is final.
     
  10. Bush Auctioneering Service  shall determine who is the successful high bidder. In the case of a disputed bid, Bush Auctioneering Service  shall have the sole discretion of allowing the transaction to stand without change, to withdraw the lot for sale, or to re-open the bidding on that lot.
     
  11. Bush Auctioneering Service  reserves the right to reject any bid without stating a reason, and Bush Auctioneering Service  reserves the right to withdraw any item from the sale at any time without stating a reason.
     
  12. If the buyer fails to meet any applicable conditions set forth in this "Terms & Conditions of Sale" statement, or breaches any New York State or Federal laws, Bush Auctioneering Service  will hold the buyer responsible for the entire purchase price of the item, along with all other expenses incurred as a result of such a breach, including legal expenses. Bush Auctioneering Service  reserves the right to, at its discretion:

        a. cancel the transaction while retaining, as part of liquidation damages, any and all payments made by the buyer
       or
         b) re-sell the property at public auction without reserve, and the buyer in breech shall be responsible for any deficiencies that result as well as all normal commissions due to
    Bush Auctioneering Service , including expenses.
     

Absentee Bids

Bush Auctioneering Service 
does not accept absentee bids. We made this a policy long ago and the general feeling is that for the folks that brave the elements to make it to the auction in person should take precedents. If you see something here on our site that is coming up for auction and can't attend, we recommend that you make arrangements with someone that is attending to place your bid.

Condition of items for auction:

Bush Auctioneering Service  will make every effort to accurately represent items that it puts to auction. We try to identify and report wear and damage. As stated before, please take the time to inspect every item, you are buying as is where is.

Property Removal

As stated in the "Terms & Conditions" of auctions, winning bidders are obligated to immediately remove their items from the auction site at the conclusion of the auction, unless other arrangements are made. Bush Auctioneering Service  is not responsible for items left unattended. In many cases, a supervised area at the auction site is set aside for items that have been purchased.  A sales receipt will need to be shown to remove items from this area.

* In the event of larger items, we can assist you in finding a hauler which will charge a fee for delivery.
